The Holding

A Williamson County patronizing-prostitution plea was vacated because the charging statute did not authorize the offense class to which the defendant pled. The Court of Criminal Appeals held that the plea could not stand on a classification not authorized by the statute charged.


Why It Matters

Charging documents in Tennessee can sometimes assign a felony classification that the underlying statute does not actually authorize. When a defendant pleads to that misclassified offense, the resulting conviction is vulnerable on appeal — even after a guilty plea.

Garcia Guox is a reminder to verify, before any plea is entered in any Tennessee criminal case, that the offense class the State is offering is one the charging statute actually authorizes. This is especially important in sting cases where the State may be reaching for an enhanced classification that the Code doesn’t quite support.
